Terms and Conditions for Accommodation Contracts

Article 1 (Terms and Conditions for Accommodation Contracts)

  1. Applicants for the use of Cardiff-Kujukuri (hereinafter referred to as "the Facility") agree to comply with these Accommodation Terms and Conditions (hereinafter referred to as "these Terms") and are required to confirm their use of the Facility in advance. Furthermore, users (those who have entered into an accommodation contract; the term "contract" is defined in the next section) must utilize the Facility in accordance with these Accommodation Terms and Conditions and under the instructions of Earth Wind Inc. (hereinafter referred to as "the Company"), the operator.
    Any issues not addressed in these Terms will be regulated by applicable laws or established customs.
    Furthermore, if the Company introduces additional terms that align with the intent of these Terms and do not conflict with existing laws or customs, those special terms will take priority over the aforementioned provisions.
  2. A contract for accommodation use, encompassing the provisions outlined in these Terms, will be formed between the applicant and the Company once the applicant submits a reservation request through the designated process and pays the accommodation fee at the time of booking. This contract will not be established if the Company determines that the applicant's intended use breaches these Terms.

Article 2 (Exclusion of Antisocial Forces)

  1. Both the Company and the users hereby assure each other of the following:
    • (1) Neither the Company nor its officers—including employees involved in business operations, directors, executive officers, or individuals in equivalent roles—are members of, affiliated with, or otherwise connected to organized crime syndicates, organizations associated with such syndicates, corporate racketeers, or any other similar groups or their members (hereinafter collectively referred to as "Antisocial Forces").
    • (2) The Facility must not be used to exhibit the influence of antisocial organizations, including through events that generate funding for these groups, and users must refrain from aiding, abetting, or otherwise supporting the operations of antisocial organizations.
  2. To guarantee the exclusion of Antisocial Forces, both the operator and the users acknowledge that they are entering into and fulfilling the accommodation contract based on each party's commitments outlined in the previous section.

Article 3 (Refusal of Accommodation Contracts)

Accommodation may be declined under the following circumstances:

  • (1) If the application for accommodation does not comply with the provisions outlined in these Terms and Conditions.
  • (2) If the Guest is assessed to potentially behave in a manner that violates laws or disrupts public order or good morals during their stay.
  • (3) If an individual’s conduct is likely to cause annoyance or disturbance to other guests.
  • (4) If the person intending to stay is a patient, etc., of a designated infectious disease.
  • (5) If a violent demand is made or if demands regarding accommodation exceed a reasonable scope.
  • (6) If the Hotel is unable to offer accommodation due to natural disasters, facility malfunctions, or other unavoidable circumstances.
  • (7) If hazardous materials (such as fire-producing devices like stoves, petroleum products, or items harmful to the human body) are brought into the facility.
  • (8) If the individual has previously been subject to the application of Article 10 of these Terms and Conditions.

Article 4 (Disclosure of Personal Information)

Applicants seeking accommodation at this facility must provide the following information:

  • (1) For each guest, include their full name, address, contact number, gender, nationality, and occupation.
  • (2) Applicant Information: Specify the expected arrival time on the date of stay, the name of the applicant's employer, along with the applicant’s name and phone number.
  • (3) Supply any other information that the facility may request.

Article 5 (Payment of Fees)

  1. Applicants for accommodation must remit the specified fees through an online payment method at the time of booking. If a guest decides to cancel their stay after having accessed the guest room, the accommodation fees will still be applicable and must be paid.
  2. Applicants may opt to pay the required accommodation fees via bank transfer, but only after contacting our Company for approval. Any costs associated with the bank transfer will be the responsibility of the applicant.
    • (1) Bank transfer payments must be received and verified by our Company at least ten days before the planned accommodation date.
    • (2) If a bank transfer payment is not confirmed by the day before the scheduled accommodation date, the reservation will be automatically cancelled. In such cases, the applicant will be obligated to pay the cancellation fees as detailed in the subsequent section.
  3. In the event of a cancellation, accommodation fees will typically be reimbursed within ten business days. This excludes weekends, public holidays, and peak holiday seasons such as summer, year-end/New Year, and Golden Week. The refund amount will be subject to deductions based on the following cancellation and refund fees:
    • (1) A refund fee of 5.0% will apply to cancellations made through credit card payments.
    • (2) Refunds for bank transfer cancellations will incur the applicable bank transfer fees.
    • (3) If the reservation period is reduced, a penalty equivalent to one day's charge (the first day) will be withheld, regardless of the number of days shortened, in accordance with the cancellation fee rate.
    • (4) Cancellations will be processed based on the following schedule. Please note that cancellation requests are handled during our business hours (Monday to Friday, 9:00 AM to 6:00 PM). Requests submitted outside of these hours will be considered received on the next business day:
    • a)  20 to 15 Days Before Stay: 20% of the accommodation fees will be charged.
    • b) 14 to 8 Days Before Stay: 50% of the accommodation fees will be charged.
    • c) 7 to 3 Days Before Stay: 75% of the accommodation fees will be charged.
    • d) 2 Days Before, Day Before, or On the Day of Stay: 100% of the accommodation fees will be charged.
    • e) No-Show or Failure to Arrive Without Notice: 100% of the accommodation fees will be charged.

All accommodation charges must be settled either through a bank transfer to the specified account or via credit card by the designated payment deadline.

Article 6 (Refusal of Accommodation)

Beyond the circumstances detailed elsewhere, the Company reserves the right to decline accommodation bookings under the following conditions:

  • (1) If it is determined that the guest qualifies under the stipulations of Article 3 (1).
  • (2) If someone other than the registered guest is present in the guest room.
  • (3) If the guest is found to fall under any of the conditions specified in Articles 3 (1) through (8).
  • (4) If the information required under Article 3 (i) is not provided or is proven to be inaccurate.
  • (5) If it is established that the guest has smoked within the premises.
  • (6) If accommodation charges are not paid by the designated deadline upon request, or if it is determined that the individual who made the reservation is not the actual guest.

Furthermore, should our Company decide to cancel a reservation, any accommodation fees already paid will be non-refundable.

Article 7 (Accommodation Registration Requirements)

On the day of accommodation, guests are required to provide the following information to the facility:

  • (1) All information outlined in Article 4 (1) must be submitted.
  • (2) Foreign nationals must present their passport number, the port of entry into Japan, and the date of entry.
  • (3) The scheduled departure date and time must be indicated.
  • (4) Any other details deemed necessary by the facility must be provided.

Furthermore, international guests without a permanent address in Japan are required to present their passport and supply a copy for the facility’s records.

Article 8
(Check-In and Check-Out Schedule)

Guests are permitted to commence check-in at the facility starting at 3:00 PM. Departure from the facility must be completed by no later than 11:00 AM for check-out.

Article 9 (Usage Regulations)

While on the premises, guests must adhere to the usage guidelines outlined in the facility's separately established regulations.

Article 10 (Termination of Accommodation)

During the agreed-upon accommodation period, our Company reserves the right to discontinue the stay under the following circumstances:

  • (1) If the guest is determined to meet any of the conditions outlined in Articles 3 (1) through (8).
  • (2) If an individual other than the registered guest is present in the guest room.
  • (3) If the guest does not adhere to the usage regulations specified in Article 9.
  • (4) If the guest partakes in forbidden activities, such as tampering with fire safety equipment or other actions prohibited by the facility’s usage rules.
  • (5) If it is discovered that the information provided during the accommodation registration process, as required by Article 7, is fraudulent or inaccurate.

Article 11 (Handling of Deposited Items)

The facility does not provide storage services for deposited belongings or similar items.
Guests who bring personal possessions, cash, or valuables onto the premises do so at their own risk. The Company will not be held responsible for any loss, damage, or destruction that may occur to these items.

Article 12 (Baggage and Personal Item Storage)

Except for the guest’s own luggage and other deposited belongings, the Company does not accept or store valuables prior to the guest’s arrival. If a guest leaves behind any baggage or personal items after checking out, these items will be handled in accordance with the Lost Property Act.

Article 13 (Parking Facilities)

Guests are provided with complimentary parking at the facility.
Parking must be requested and arranged at the time of making a reservation. The facility permits a maximum of three vehicles per reservation. The Company does not take responsibility for the management or supervision of parked vehicles.

Article 14 (Disclaimer)

Guests shall use communication devices within the facility at their own responsibility. The Company shall not be liable for any damages incurred by guests as a result of service interruptions caused by system failures or other reasons during the use of communication devices.

Article 15 (Guest Obligations)

  • (1) Should any part of the facility be damaged, degraded, or defaced by a guest during their stay, the guest is responsible for reimbursing the Company for the expenses required to restore the affected areas to their original state, as well as for any additional damages incurred by the operator. In instances where equipment is damaged, charges will reflect the actual costs of repair or replacement.
  • (2)  If a guest is involved in a personal injury incident or causes other forms of damage during their use of the facility, and such incidents are not due to facility malfunctions or issues, the guest holds sole responsibility. The guest must directly compensate any affected parties at their own expense, ensuring that neither the operator nor any third parties bear any financial or inconveniencing burdens as a result.
  • (3) In situations outlined in the previous sections, should a third party hold the Company liable and require compensation, the Company retains the right to seek reimbursement for all costs associated with such compensation from the guest.

Article 16 (Check-Out Procedures)

  • (1) Guests are responsible for removing all personal items and equipment they brought into the premises at their own expense. The facility must be returned to its original condition by cleaning the area and washing or cleaning all furnishings and equipment. Guests must fully vacate the facility by the designated check-out time.
  • (2) All restoration tasks mentioned in the previous section must be performed in accordance with the "Restoration Specifications Document.
  • (3) If Guests fail to complete the restoration by the check-out time, they shall be required to pay the Company overtime extension fees for the additional time taken to finish the restoration. Additionally, Guests must compensate for any other damages incurred by the Installer and the Company. These fees will be calculated at twice the standard hourly rate and billed in 30-minute increments.
  • (4) Should there be any problems with the restoration as outlined in Paragraph 1, including hidden issues such as remaining nails or other items that could pose physical dangers, resulting in damages to the Company or third parties, Guests must compensate for those damages.
  • (5) All items brought into the facility by Guests (including food and beverages) must be removed by the Guest. In the event that any items are left behind, the Company may dispose of them at its discretion, and the costs associated with disposal will be the responsibility of the Guest. Guests acknowledge and agree in advance that they will not object to the disposal of any remaining items.
  • (6) Waste must be separated according to the methods designated by the facility. The Company will provide explanations of the waste separation procedures to Guests. Guests are required to fully comply with and familiarize themselves with these waste separation methods.

Article 17 (Noise Control and Environmental Maintenance)

Guests must adhere to all applicable noise regulations and follow the Company's guidelines regarding noise levels while utilizing the facility. Moreover, guests are encouraged to help preserve and protect the surrounding environment.

Article 18 (Security Cameras)

Guests acknowledge that the Company will operate security cameras to capture video footage for the purposes of ensuring security, monitoring the use of the facility, and managing facility operations.

The Company will refrain from sharing footage with third parties except under the following circumstances:

  • (1) When required by applicable laws or regulations.
  • (2) Upon receiving a written request from investigative authorities for the purpose of criminal or accident investigations.
  • (3) In situations where it is urgent and necessary to protect an individual's life, health, livelihood, or property.
  • (4) When explicit consent is obtained from the individual concerned.

Article 19 (In Case of Emergency)

  • (1) During the use of the facility, guests are required to proactively review fire-fighting equipment, evacuation routes, and other necessary protocols to be prepared for unforeseen events. Additionally, guests must ensure that all concerned parties are comprehensively informed about these emergency procedures.
  • (2) In the event of earthquakes, fires, or other emergencies, should relevant government authorities issue specific instructions, guests must follow these directives and respond appropriately, assuming full responsibility for their actions.

Article 20 (Submission of Documents)

When necessary, the Company may request that guests provide various documents, including but not limited to identification papers, company brochures, up-to-date certificates pertaining to current affairs, seal registration certificates, and any other documents as specified by the Company. Guests are required to comply with these requests and submit the requested documents accordingly.

Article 21 (Notwithstanding any of the provisions of this Terms and Conditions)

In the event of any disagreements or conflicts arising from the provisions of these Terms and Conditions, such issues shall be addressed and resolved amicably through sincere discussions. The primary focus shall be on ensuring that Guests can utilize the facilities smoothly and for appropriate purposes.

These terms and conditions were put into effect in August 2024 and may be updated in the future.
